By using Viraly Post, you agree to these Terms. You're responsible for what you post and for following each social platform's rules (Instagram, TikTok, LinkedIn, etc.). We provide the tool "as is" and our liability is limited to what you've paid us in the last 12 months. Subscriptions auto-renew. You can cancel anytime. Brazilian law applies.
These Terms of Service ("Terms") form a legally binding agreement between you ("you," "your," "User") and VIRALY POST LTDA, a Brazilian limited liability company registered under CNPJ 65.654.417/0001-13, with registered office at Rua São Vicente de Paula, 81, Agronômica, Florianópolis, Santa Catarina 88025-330, Brazil ("Viraly Post," "we," "our," "us").
By creating an account, accessing, or using the Services in any way, you confirm that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree, you must not use the Services.
You also confirm that you are at least 18 years old and have the legal capacity to enter into this agreement, and that if you are using the Services on behalf of a company or organization, you have authority to bind that entity to these Terms.
Viraly Post is a software-as-a-service ("SaaS") platform that enables social media managers and agencies to schedule, publish, and analyze content across multiple social media platforms from a single interface.
The Services include, but are not limited to: scheduled posting, content calendars, client approval workflows, multi-account management, and performance analytics.
We may add, remove, or modify features at any time. We will make reasonable efforts to notify you of material changes.
To use Viraly Post's publishing features, you must authorize us to access your accounts on third-party platforms such as Instagram, TikTok, LinkedIn, YouTube, X (Twitter), Facebook, Threads, Pinterest, Bluesky, Reddit, and others (collectively, "Third-Party Platforms"). You grant us a limited license to publish, schedule, edit, delete, and retrieve analytics on your behalf via the official APIs of those platforms, strictly as needed to deliver the Services.
Viraly Post is not affiliated with, endorsed by, or sponsored by Instagram, Meta, TikTok, LinkedIn, YouTube, Google, X Corp., or any other Third-Party Platform. All platform names and logos are trademarks of their respective owners.
Each Third-Party Platform has its own Terms of Service, Community Guidelines, Acceptable Use Policies, and API rules. You are solely responsible for ensuring that your use of Viraly Post, including the content you post, the frequency of posts, the accounts connected, and any automation, complies with the rules of each platform.
This includes (but is not limited to) the policies of:
Third-Party Platforms can modify, restrict, or terminate their APIs at any time without notice. If a platform makes changes that prevent Viraly Post from offering a particular feature, we may modify or remove that feature without liability to you.
If you connect accounts that belong to your clients or third parties, you represent and warrant that you have full written authorization from those parties to do so. You are responsible for ensuring your clients' compliance with these Terms and the rules of each platform. You will indemnify and hold us harmless from any claim arising from unauthorized access to a client account.
Viraly Post is offered as a paid subscription with multiple tiers (Starter, Pro, Scale) on monthly or annual billing cycles. Current pricing is available at viralypost.com/pricing.
New users may start a 7-day free trial by providing a valid payment method. You will be charged automatically on day 8 at the subscription rate corresponding to the plan you selected, unless you cancel before the end of the trial.
All subscriptions automatically renew at the end of each billing cycle (monthly or annually) at the then-current rate, until cancelled. By providing a payment method, you authorize us, through our payment processor Stripe, to charge that method for each renewal.
We may change the prices of our plans. Price increases will not apply to your current billing cycle but will apply at the next renewal. We will notify you by email at least 30 days before any price increase takes effect.
Prices displayed exclude applicable taxes unless explicitly stated. You are responsible for any sales tax, VAT, ICMS, or other tax that may apply in your jurisdiction.
You may cancel your subscription at any time from your account settings or by emailing contact@viralypost.com. Cancellation takes effect at the end of your current billing cycle, you continue to have access until that date.
If you are not satisfied with Viraly Post within the first 30 days of your first paid subscription, we will issue a full refund. Request a refund by emailing contact@viralypost.com. After 30 days, all fees are non-refundable except where required by applicable law.
Except as stated in section 6.2, we do not provide partial or pro-rated refunds for unused portions of a billing cycle.
You retain all rights, title, and interest in the content you upload, create, or schedule using Viraly Post ("User Content"). We do not claim ownership of your content.
To enable us to operate the Services, you grant Viraly Post a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, transmit, display, reproduce, modify (for technical purposes such as image format conversion or resizing for each platform's specifications), and distribute User Content solely as needed to deliver the Services to you. This license ends when you delete the content or your account, subject to backup retention as described in our Privacy Policy.

We reserve the right to investigate and take action, including suspension or termination of your account, without refund, against any user who we believe, in our sole discretion, has violated this policy.
All rights, title, and interest in and to the Viraly Post platform, including all software, designs, logos, trademarks, text, graphics, and underlying intellectual property, are and remain the exclusive property of Viraly Post and its licensors. These Terms do not grant you any right to use Viraly Post's name, logo, or trademarks without our prior written permission.
Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you in full. In those jurisdictions, our liability is limited to the maximum extent permitted by law.
You agree to indemnify, defend, and hold harmless Viraly Post and its owners, officers, employees, agents, contractors, and partners from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or relating to:
You may terminate this agreement at any time by cancelling your subscription and deleting your account.
We may suspend or terminate your access to the Services, with or without notice, if:
Upon termination, your right to use the Services ceases immediately. Sections that by their nature should survive termination (including IP, disclaimers, limitation of liability, indemnification, and governing law) will survive.
These Terms are governed by and construed in accordance with the laws of the Federative Republic of Brazil, where VIRALY POST LTDA is registered, without regard to conflict of law principles. The application of the United Nations Convention on Contracts for the International Sale of Goods is expressly excluded.
Nothing in these Terms removes or limits any consumer rights that apply to you under mandatory laws of your country of residence that cannot be waived by contract. Specifically:
Subject to Section 14.2, any dispute arising from or related to these Terms or the Services that cannot be resolved amicably shall be submitted to the exclusive jurisdiction of the courts of the Comarca de Florianópolis, State of Santa Catarina, Brazil, with express waiver of any other jurisdiction, however privileged it may be, except where applicable consumer protection laws of your country of residence grant you a non-waivable right to bring proceedings in your local courts.
Before filing any formal claim, you agree to first contact us at contact@viralypost.com with a written description of the dispute and attempt to resolve it informally in good faith for a period of at least 30 days.
To the maximum extent permitted by applicable law, if you are a customer in the United States, you agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
We may modify these Terms at any time. If we make material changes, we will notify you by email and post a notice on our website at least 30 days before the changes take effect. Continued use of the Services after the effective date constitutes acceptance of the revised Terms. If you do not agree to the changes, you must stop using the Services and may request termination of your account.
